1. Acceptance of Terms
By accessing and using the Nimbu platform (hereinafter, "the Service"), you agree to be bound by these Terms and Conditions. If you do not agree to any part of these terms, you may not access the Service.
2. Description of Service
Nimbu is a cloud-based school management platform (SaaS) that provides tools for student administration, grading, attendance, family communication, payments, and reporting for educational institutions.
3. Registration and Accounts
To use the Service, the institution must register by providing accurate and up-to-date information. The designated administrator will be responsible for managing user access within their institution. Each user must maintain the confidentiality of their access credentials.
4. Acceptable Use
The user agrees to use the Service exclusively for legitimate purposes related to educational management. It is prohibited to: (a) share access credentials with unauthorized persons; (b) attempt to access data from other institutions; (c) use the Service for purposes other than educational ones; (d) reverse engineer the software.
5. Intellectual Property
Nimbu and all its content, features, and technology are the property of Nimbu S.A.S. and are protected by applicable intellectual property laws. The data entered by institutions is the exclusive property of each institution.
6. Billing and Payments
Plans are billed monthly according to the contracted plan. Prices may be updated with 30 days prior notice. Failure to pay for more than 60 days may result in suspension of the service, with prior notice and a grace period.
7. Cancellation
Either party may cancel the service with 30 days prior notice. Following cancellation, the institution will have 90 days to export its data. After that period, the data will be securely deleted.
8. Limitation of Liability
Nimbu is committed to maintaining service availability with a minimum uptime of 99.5%. However, Nimbu shall not be liable for indirect damages, data loss caused by user misuse, or interruptions caused by factors external to the service.
9. Modifications
Nimbu reserves the right to modify these Terms and Conditions. Changes will be notified at least 15 days in advance through the platform and by email to the administrator of each institution.
